The Vietnam Centre for Protection of Music Copyright (VCPMC) on June 9 sent a formal complaint issued by 371 living artists and families of late-artists to competent bodies that their legal rights are being abused by some agencies.
Among artists who signed the complaint are famous, old song writers like Pham Tuyen, Nguyen Tai Tue, Doan Nho, Nguyen Duc Toan, Phan Huynh Dieu, Phan Nhan, Thuan Yen, Hong Dang and Nguyen Tai Tue and newly-emerging faces Do Bao, Giang Son, Anh Quan, Quoc Trung, Ngoc Chau and Huy Tuan.
In the complaint, which was sent to the Radio Voice of Vietnam (VOV), the Vietnam Television Station (VTV), the digital TV Station (VTC) and all cable TV stations in Vietnam, song writers say that these agencies have paid royalties to song writers but these are initial royalties, not the sum to definitively buy their songs and music so these agencies can’t freely use their works.
These agencies also use a large number of music works from different sources and most song writers don’t receive any royalties from these broadcasting and television agencies.
Artists recognise VTV as the first agency to begin paying royalties in 2004. However, the royalties are still too little. VTC and cable TV service providers still haven’t paid music royalties yet, they say.
Vietnam has many laws and regulations protecting copyright but intellectual property infringement is still a burning issue. In the field of music, there are two organisations that represent artists to protect copyrights, the VCPMC and the Vietnam Record Association.
In January 2008 the government instructed the Ministry of Culture, Sports and Tourism to combine with VCPMC and related agencies to compile an instruction on music copyright protection.
